Im waiting for a single video or stream of Asmond or Esfand openly and knowingly exploiting anything.
In fact, both went out of their way to discourage layer tactics per their streams.

According to Blizzard thatās not the case, if you used layering as just explained by Lore then you were exploiting. And you deserve penalties commensurate to the level of exploitation engaged in.

They only banned intentional exploiters.
Anyone who ran into the exploit unintentionally, streamer or nor, has not been punished, i.e those who are not streamers also get to keep what they got.

If was an accident and the players have no intention to exploit the bug, have no reason to punish the players or remove their loot.
