No, the flaw is in your bias. The number of false bans are beyond infinitesimal when looked at per capita. We are talking a few out of thousands if not millions. If there were a obvious flaw in the process there would be way more false positives.
Blizzard has very clearly stated that the amount of false positives are way lower than most players like to claim. In fact not long ago there was an error detected in how some bans were handled in a PvP ban wave, there was a mistake in one of the formulas used. Blizzard was very upfront and put out a release about it.
Just look through this forum for every thread with someone like you that had an account action reversed, there are a hundred where the person is either called out and straight up told they are mistaken and that the action is valid by the Blues here, or they are given a reduced penalty because Blizzard agreed that that penalty was too severe. However that still means the underlining action was indeed correct.
You can look up at the blue post saying my appeal about this was resolved.
