Nobody took anything from another player.
It is not unfair, it is a dice roll. Anyone can envision an issue but that does not beget one.
How would it be fair for someone to be unable to roll on an item they could use, when they were a contributer to the fight, just because someone else was lower level?

Nope. The game is gear based. The transmog option should be a completely other roll. Or just GIVE the GD mog appearance when the item drops.
Making an appearance a part of the competitive grind is just asking for issues like this.
Yes, tmog is forever, but OP could want the mog just like the person who Needed for the mog, but guess which person between OP and the mogger NEEDED the upgrade?

That’s not really how issues work. If my leg falls off and my doctor says I’m whining about a non-issue, that does not make it so. You don’t get to unilaterally determine what’s an issue and what’s not.

The only reason I got it was by whispering someone and they were nice enough to give it to me.
