Do artists or writers who happen to be black or disabled and use their own experiences to create a character fall under that “culture” to you?

I doubt that the person who created Faerin is a one-eyed, one black woman - and even if it was that still doesn’t mean you get carte blanche to insert every one of your Intersectional Points into places where it doesn’t fit. There’s a reason Avowed didn’t resonate with people even if the creator was trans.
