You probably should read that ToS that you clearly have not, because it says, in a lot more words, you are not guaranteed the ability to play. You are paying for the privilege to play not the right to play.
Now with that said, yes blizzard needs to do something about this i agree. HOWEVER, you also picked a mega server so if you picked that server yourself knowing that, you are kinda the only one at fault here.
