australian consumer laws can not and will not do anything in this specific situation - you have full access to the service that they provide, you have options to use your existing resources on the service

layers will be turned back on once they see the pure poop show that they’ve caused but lets not pretend that there will be any action past this.

If players have subbed with an expectation of reasonable access to game servers and this access is no longer being made available, regulatory bodies absolutely will do something. Its more likely to be a complain heard by the consumer ombudsman though.

your refusal to accept reality isnt grounds for legal action

The nature of the service being provided has materially changed, so materially in fact that for many players they are unable to access the server. This is grounds for legal action.

wrong, a reversible service change was made which will be changed back or otherwise resolved with other means

you really have to stop with the irrational thinking and over evaluation of what your rights are in this situation, give it a few days and it’ll be fixed

thats not how any legal system works. even in north korea people understand that if a non essential service that was originally provided a certain way slightly deviates from the way it originally went about, that is not grounds for legal action, they just go to a different provider of that service.

if blizzard took your money, made the game unplayable, and didnt offer a refund, that would be false advertising and theft. the game is perfectly playable, you just have to wait. something which anyone who understands how vanilla wow works would have expected.

The fact that we even have to debate this is, is grounds that the service being provided is not what consumers are paying for. The ACCC will defend Australian consumers in this instance. At the very least, while this is being resolved, Australians should not have to pay for the service.

yes we’re all aware that the company has gone down the toilet but that doesn’t justify your opinion on this being even remotely considered by the ACCC as a problem - it was a system change that can be rolled back and mitigated, and I have absolutely no doubt that something will be done in the coming days.

the service you are paying for is operational and available, your subscription fee is not locked to one singular server, if it were, then you’d have a case. that’s the loophole that would be used in every single possible scenario that this can play out in.

most arguments dont go to court, because when the complaint relates to a $15/month subscription, the threat is enough for the company to just pay a full refund :slight_smile:

Yep, and if you’re lucky the ACCC does nothing. If you are unlucky they contact Blizzard and they pull their services out of Australia. Blizzard is not an Australian based company. The ACCC can do nothing to them if they pull their services from Australia. Because they are not based there they have little profit tied to Australia. Australia is worth about 15k subs to Blizzard/Activision. If you do the math on that you will see that legal fees and potential pay outs are not worth 15k subs. It is a no brainer what Blizzard/Activision would choose to do.

A: You agreed to the EULA, which explains this might happen. So you were warned in advance.

B: The service was crippled by the users, the users were warned if they did things a certain way this might happen, they didn’t listen. That’s on the users, not Blizzard, who issued AMPLE warnings.

C: The EULA is still legal, even if you think it’s “b.s. to comply with local laws”.
