No, the guild and everything in it belongs to Blizzard. You failed to secure the guild, so you abandoned it. The mistake was yours.

Fix the mistake
Theres no arguing this feature is helpful theft of the game property of others. You know its a bad feature for anyone who cares about the game.
Did you take steps to ensure that your guild could be taken from you in the event of your extended absence? All you had to do was make sure all members were demoted to no higher than Rank 4. That’s on you. If any of your guild members were Rank 3 or higher, they were eligible to dethrone an absentee guild leader (you).
The guild belongs to the guild leader. That includes the guild bank and everything in it, including any gold. Once you were dethroned, the new guild leader was empowered to do whatever he/she wanted with the guild, including kicking everyone else out and draining the bank.

I’m sorry, Zushe, but the only mistake that was made is that you did not properly manage your guild to prevent members from being able to dethrone it when you were absent for 90+ days. It is unfortunate and I absolutely do understand your frustration but this stomping about isn’t going to end well.
