Speaking of Portal 2 and A Certain Scientific Railgun: both have mention of Asbestos with Portal 2 outright mentioning that Aperture is made of Asbestos while A Certain Magical Index GT Volume 1 has Mikoto Misaka outright worry about a building she rescues Index from being potentially made of Asbestos!
I dare say she constantly worries about Asbestos whenever she is dealing with structural damage to her surroundings though unlike Portal’s Chell she does not know for certain that the threat is there which will probably make it worse rather than letting her come to terms with her fate!

eye roll Folks. That’s not how trademark law works.
Trademarks are about owning a mark in a specific category. So if a customer were to go buy a product in a very specific category they would associate your company with a particular product. At no point do you own a name. You own a mark that makes people think of your product.
EG
Action ARPG all about collecting loots , what’s the first name you think of ? -> Diablo -> Blizzard Entertainment
Cartoon mouse with overly large hands and litigous lawyers (don’t tase me bro) -> Mikey Mouse -> Disney Entertainment
In this way it’s possible to have multiple trademarks registered to multiple different companies.

And they’re seeking trademarks in merchandising catergories like Toys that overlap with Blizzard’s trademarks.
Then again. Isn’t Fox owned by Disney now. Who have famously litigous lawyers and are known to re-write copyright/trademark law.
I feel like there is more going on then just a name dispute. Something must have happened that Blizzard thought the TV show version was close to the game version.
Diablo is one of the few ways to say devil and from what I know Blizzard doesn’t have the name copyrighted so again, there is more going on then just name issues.
Also ya, Disney is not a company that I would mess around with when it comes to copyright issues. I looked carefully into Alice in Wonderland copyright before I used it in my business as I didn’t want them breathing down my neck.
It is very rare that a name itself is locked behind copyright. Usually it is more the character.

You usually can’t. But they can own the copyright to their version of Diablo. And that is why I think this is popping up. The TV show might be close to “Their version” and that is why something is happening.
I’ve looked at the trademarks Blizzard has and the ones Fox is applying for.
The Fox ones should never of passed the application stage and should of been rejected a lot earlier based on there already being commercial use in the category they are filing under.
The categories they are filing under overlap the ones Blizzard has ones for. It’s not about confusing the TV show for the video game and vice versa. It’s about having Toys on the shelf from both companies and one Toy range being confused for the other Toy range.
That isn’t what’s happening here. When you trademark you own the mark only not the word itself. Trademarks cover specific products which is why you have multiple trademarks for “Diablo” across many different products and has been for years.
No what is actually happening is Fox is trying to get trademarks for merchandising and toys in the same categories Blizzard already has trademarks in.
Trademarks work in specific categories. This is how you can have a trademark for the Video game Diablo and the weed killer Diablo. You don’t confuse a video game with a weed killer. There isn’t any chance of a consumer going to a store and bringing back someone else’s product with the same name so hence there isn’t a chance of someone walking into a video game store and bringing back a game called “Diablo” that isn’t from Blizzard Entertainment.
Now if Blizzard didn’t defend it their trademark gets diluted as consumer association of whose product is whose is diluted. Also it would make it very difficult to argue in future legal cases. So they have to defend it as otherwise their trademark is eroded.
Ya I don’t know anything about trademarks so that is my bad. I am more familiar with copyright as I have to be. I am an author.
