There is no lawsuit because you can’t play on a specific server due to a queue.
Take the transfer they offered, pay for a transfer, or sit in queue. It really is that simple. There is no lawsuit, there is no magic fix and you will not be reimbursed for anything.

Good luck. My guess would be no reasonable firm would take your case, besides the fact that Blizzard has enough funds to pretty much bury any legal proceedings for a very extended period of time.
You are able to play on other servers with no queue. They don’t HAVE to let you onto a specific server as long as they have servers available to play on.
Laywers will take almost any case, but you can determine their confidence level based on if they agree to a portion of the settlement or charge a flat fee.
Due to the existence of free transfers and alterate locations to play would be almost impossible to get a judge to find Blizzard liable

No, and even if you could find a law firm shady enough to take the case it wouldn’t even get past a motion to dismiss which would be the 1st thing the Blizzard lawyers would do and they’d win on the ground that you’re paying to play a game not play on a specific server, and there are other servers to play on and they offered free transfers off the server you’re on to try to help with the queue.
You’ve also got to consider that Classic is considered “Free” with the World of Warcraft subscription which is for Retail, which you can also play with no issues currently.

Which is why the concept of being locked to a server is outdated and is causing more issues. PPL dont want a dead server so they join a populous one (shocker). Then there’s a queue problem (shocker again).
They really should upgrade their game and allow ppl to log on any server after login.
The only challenge I could foresee would be how to manage a guild in such a concept. You’d need to have a guild chat across server and unified server AH (maybe a dedicated server to handle all the AHs everywhere) too to prevent idiots from manipulating the economy.
I completely get both sides of this situation myself, just glad I hit paydirt on choosing my server this time as opposed to 2008 where I ended on a mostly dead server after a year.

Guess what we are wanting to play, classic. We are asking them to put up a outdated product that includes alot of outdated concepts shocker.
Its been possible to make servers “Free” to move between for a long time even pre wow see runescape. Wow was never made to be that type of game thou and we are not paying to play that type of game. In fact one of blizzards stated “pillars” of classic is server community’s and doing that makes server community mean nothing. So it goes directly adverse to the stated goal of classic.
As for the OP no you got 0 grounds. You signed a agreement known as a TOS. This agreement includes what you are paying for which is SERVER access, this is NOT realm access. The fact you are in que means blizzard has met there complete legal obligation. This is further backed up by another clause that states blizzard is not liable for outages for any reason including but not limited to big list of stuff. One of those items is high use. Which is exactly what ques are. So this case is literally one of the vary examples you agreed to be ok.
