Oh, you absolutely can. The EULA is a legally binding contract that both sides must adhere to and if a contract is deemed unenforceable a court can order all sorts of things to remedy the issue ranging from striking a particular clause from the EULA to deeming the entire document unenforceable.

Blizzard has 100% been playing fast and loose with this stuff for a very long time and this is standard practice for publishers. They’re banking on people not pushing back through the legal system - but they can and their lawyers can get into serious trouble for it (the bad faith EULA clauses that any 1st year law student knows isn’t acceptable).

Right. It could be thrown out as unenforceable, but I doubt that would happen, and unless that happens, then they do not need to even give you a reason for the ban.

I have a feeling their lawyers have thought about that and have done their homework.

Like I said, all it takes is 1 pissed off rich dude who wants to make a point. Blizzard’s EULA 100% has unenforceable clauses in it and Blizzard’s lawyers are on the hook for those bad faith clauses, they can be sanctioned for it.

I agree with that. Esp if they pay real money.

Although there is something to be said for being IN the dungeon in close proximity to the group vs standing in Town!

I have no idea. I can’t see your ticket. MVPs are other players. I have a lot of experience with the policies, rules, and procedures, but I have zero access or power. I can’t moderate forums either.

I mean, sure that is fine. They don’t care about other people though and you are just guessing at why you got banned.

They will look at your account, the infraction listed, and compare it to the evidence. If it appears the account did violate the listed policy, they uphold it. If not, they overturn it and apologize. The folks handing reviews don’t make the policies.

Now, if there was a huge banwave and the Hacks team realizes something was amiss in their detection criteria, they will notify the folks doing reviews, and usually also go back and reverse any that were falsely penalized.

They don’t ban people for minor use of an exploit or accidental use. They only target people who excessively used it for significant gain. That is not “innocent” use.

I get it, you don’t want to be told that so you are lashing out and trying to insult me. It won’t make you feel better.

It is not ok to steal things if a door is left unlocked. It is not ok to massively exploit a game flaw for gain either. These are simply truths.

You say that like you think OP is not innocent.
With the option available to OP that he can make his ticket (eventhough after a week he may expect an response. wich is atrocious btw).
He is still, in regard to the forum, untill the moment he is not able to post here, presumed innocent.

I never said he was not innocent. I gave him the means to appeal and explained the process. I did explain the category of the ticket infraction he received. You also quoted my replies to someone else, not to the OP. I have no idea what the OP did or did not do. They can appeal. I was discussing the general category with other posters.

Again, MVPs don’t work for Blizzard.

People get false bans all the time. I’ve been banned several times in WoW and got it appealed.

If you bought gold in D4, I hope you all get banned.

Ok, you don’t like my tone as I was talking to other posters, not the OP, about exploiting in Blizzard games and Blizzard policies. You seem to have misunderstood the conversation and think I am somehow accusing the OP. Go back to my first reply to the OP. and any of my other direct replies to the OP. Focus on those if you want to criticize my tone with the OP.

I’m guessing re-running Dungeons with parties or something.
Or sharing password/account with others, etc. There’s bound to be something fishy for Blizzard to outright ban an account.

I also got banned without any reason…joined buddy’s game and he was afk and did a side quest dungeon with him afk and got kicked and now account has been banned. Reason given was game exploitation…? seriously blizzard?

Same here, I play the side Quest Mother’s Renunciation.
I wittern often You not my Mother in the chat an got banned…

I don’t understand how a player is suppose to know if the dungeon has correct elite monster density or not. Some dungeons have more elite monster density than others, and are fun to run over and over, if it’s not intended to be that packed that’s on Blizzard.
