I read what you said here and Im not 100% sure that names cant be mentioned in this instance, yes he is criticisizing the streamer perhaps if it was delivered in a different fashion – Like did you see what XQCDROM [made up name] said this morning…
at some point there when you become a ‘public figure’ the legality of libelous or harassing statements shifts – Im so tired I am not wording this well.
Again, there is a difference between slander or liable. Naming someone who publicly posts/says something and giving your opinion on it, is something that happens world wide every single day in every home, workplace, coffee shop, news channel, talk show, interview, etc. Really, talking about what someone else said and giving an opinion on it is part of basic social discourse.
Now, you might conclude someone is rude, based on their language, and choose not to follow, watch, or hang out with that person, but they still have basic rights.
The only place they don’t allow “callouts” is on the Blizz forums because 9 times out of 10 it is done to cause fights/troll or make accusations the person can’t substantiate.
You are mixing real world law regarding public figures trying to sue when people say something they don’t like vs Blizzard forum rules.
I kind of just addressed it when you were typing. Blizz just does not want call outs here, even if it is a well known person, because it tends to lead to fights/trolling or accusations the accuser can’t back. Blizz does not want moderate personal “fights”, nor do they let us post threads accusing folks of cheating/botting, etc.
I understand the harassment policy and although I am curious to who the streamer is and why any streamer would expect to find purely intelligent arguments made on any given forum I can live without knowing…
here’s:
In the context of [defamation]) actions (libel and slander) as well as [invasion of privacy], a public figure cannot succeed in a lawsuit on incorrect harmful statements in the [United States] unless there is proof that the writer or publisher acted with [actual malice
The legal [burden of proof] in defamation actions is thus higher in the case of a public figure than in the case of an ordinary person.
LOL cleaning up wikipedia links cuz I cant link links is interesting how many lil things get converted
And of course I understand Blizzard has its own rules but they still act with reason pause most of the time … On OW forums people openly discuss streamers all the time – kinda weird
Got to admit, the streamer got point though. To be fair, if Blizzard is going to take any action it should be on both side of the ball. Anyone who has bashed fluffy on the forums as well as fluffy. Bam… fair is fair.
The will not see it that way, it is okay for them to point the finger at others but they melt under the heat when it is directed at them. This forum is full of hypocrites. All this over a game.
The streamer pointed up the barbarian collective tantrum, but did nothing wrong himself. He made his point very effectively that [redacted] has been an elitist jerk for years. He pointed out how ridiculous some of the arguments were. He pointed out, and this one I disagree with, that the build might have been capable of 150 pre-nerf. The streamer even encouraged anyone who viewed the thread to be respectful if they choose to reply.
I never once said or believe the streamer did anything wrong. Just that if Blizzard is going to take any action, posters here who have violated any rules needs to be punished too.
In all honestly, I think the community should be happy anyone still brings attention to this game by streaming it rather than attacking the streamer.
HAH, I got actioned for comparing the D3 dev to Jimmy Hoffa (who disappeared) or a bomb sniffing dog with allergies (basically useless). The comment was made in jest, and it turns out I was right - the D3 team was reassigned. But I still got actioned. I try to stay on the right side of that line.
I agree with this policy. This whole issue went from a tweet, to a thread created on this forum bashing the streamer, to flaming the streamer when the streamer came here to clarify, to then pretending this whole issue started with the tone of the stream.
This is one of the most passive aggressive attempts I have seen on this forum to try to malign or silence someone with a different opinion of the game.
My personal opinion is that threads like this should be locked outright - not allowed to continue when everyone knows who certain posters continue to talk about - the same in the ‘please don’t nerf barbs’ thread where people continue to harp on about a situation they (some, and partly) brought on themselves.
I would disagree barbs brought this on themselves, if you mean the Rend nerf. I would 100% agree if you are referring to the streamer mocking their ridiculous arguments.
Free got me suspended by turning into a political debate and then personally insulting me and my right to an opinion. But of course only I got flagged. He deserves a little time out.
Why? Lord fluffy regularly has 400+ watching his stream. Why wouldn’t he vent on HIS platform? He responded to the barb community multiple times. And all of this is about him calling lamentation a small nerf. Not even a nerf that he advocated for. I guarantee if free wanted to mic up and speak on stream fluffy would do it, he has in the past with other people. Free did nothing wrong. Fluffy did nothing wrong. The people who did something wrong are the two that started this thread and the last thread that got closed down.
I guess nobody here realizes if Blizzard would of released the Patch to streamers with the Patch Notes that everyone could see, none of this would of happened. All the blame, anger and that followed would of been put on the appropriate shoulders.
So much for the better communication that was promised.
The amount of posts saying “grow thicker skin” or “snowflake” in this thread is appalling. This is the same than saying to people suffering from depression “just be happy”.
That’s not how it works. As a target of bullying by a league of legends streamer in the past, let me tell you, being called all sorts of names on stream in front of hundreds can put your mind in a dark place. I even received threats in my reddit PM because he showed my reddit name and post on his stream.
Online influencers should not use their power to bully their way out of a FORUM argument. Notice how some of the ppl he showed in his stream and OP haven’t posted for a while… That’s because they have been target flagged and auto-muted. So now they are powerless AND voiceless.
This post brings awareness to an issue that should NOT be taken lightly IMO.
