Blizzard owes you no duty with regard to the balancing of the game. Under the Uniform Commercial Code, Section 2-314, there exists a portion within contract law called the implied warranty of merchantability. Simply put, even if there no warranty for a product, the UCC creates a warranty for the product guaranteeing that the product which you have purchased is viable for it’s intended and described purpose. With respect to World of Warcraft, you purchased World of Warcraft with the understanding that it is an MMORPG (Massively Multiplayer Online Role-Playing Game.) The fact that you are able to log in, interface with the game, engage with the content, and interact with other people with minimal server downtime fulfills the implied warranty of merchantability.
Conclusion
While you can feel free to take this case to court if you so choose, for the reasons listed above, there’s an overwhelming possibility that your case will not even make it to the discovery phase, instead resulting in the defendants entering a successful motion to dismiss, followed by a judge telling you to “get rekt nerd.”
