Gargoyle and Dark Arbiter are supposed to be identical, but Gargoyle deals Plague Damage, while Dark Arbiter deals Shadow Damage, which means Gargoyle is inherently better than Dark Arbiter because Plague Damage will check Shadow and Nature resistances and pick the smaller resistance.
So there are times when Gargoyle does more damage than Dark Arbiter, but there’s never a time when Dark Arbiter does more damage than Gargoyle.
Even if it’s a small difference, it’s bad to attach a dps loss to a cosmetic choice.

Yeah but if a Val’Kyr Attacks me because she’s my enemy compared to a rock monster, I’d receive some EMOTIONAL DAMAGE from her.
So she’s fine

I never knew dark arbiter was a thing until right now. And I mained an unholy dk in shadowlands! 
I never liked using gargoyle though, so I would have never looked into it!
But yeah, that is something that should be rectified. They even note the difference on the wowhead page about it. Am I right in thinking when the dark arbiter was added they didn’t have plague damage as a category? When was that a thing?

Yeah, you can speak with an NPC and trade your Gargoyle for a hot bikini angel viking lady 
It’s a dps loss though.

They fixed that though by removing his dual wield.
