A good rule of thumb is to disregard any twitter witchhunt. In fact, disregard Twitter entirely.
As far as the guy not getting on Twitter and proclaiming his innocence…he did the right thing. There’s no upside for him discussing this as the mob has already made up its mind. Anyone with any sense who was in his situation would stay quiet and let his lawyers handle it, if it even came to that.
Edit re the above post: I can only speak from personal experience but I’ve yet to see anyone go to jail over a false accusation/police report about this type of thing. It might get referred, but I’ve never seen it pursued. It’s frustrating, but it is what it is. ymmv
Separate causes of action with entirely separate courts as well.
Defamation is a civil action initiated by the defamed individual.
Falsifying a police report can be either misdemeanor or felony level and is charged by the State
As we saw with the OJ Simpson trial, you can nail someone for wrongful death (civil action) but not see them successfully convicted for murder (criminal action). In the case of filing a false report, there is typically an element of intent involving trying to disrupt the justice system to make it stick, which can be tough when the aim was to go after a 3rd party but not necessarily frustrate the police. Plus, the DA has to actually find the issue worthwhile to pursue, even if the defamation action caused millions of dollars worth of reputation damages.
Finally, even if you manage to achieve felony levels of falsification, you’re looking at a few years of prison at most, which you’d never receive on your first or even second time doing it or other crimes. Most likely you’re paying a hefty fine to the State.
All true, and I’ll take it a step further. They can accuse you, let you spend a few days in jail, then drop the charges and never even have to talk to a judge.
And yet we still can’t figure out why the marriage and birth rates are the lowest they have ever been in almost every western society/country.
This nation and “the west” lost it’s morality entirely, this is what a godless society descends into. Not saying that everyone should be religious, but that spiritual faith component of society it’s a strong moral compass that keeps society overall in good health. Without those “rules” for the lack of better words a free society will descend into chaos and confusion where even simple things like 1+1 no longer equals 2, and people look for any possible edge at anything no matter what because it’s no longer considered bad to be a dirtbag; instead it’s ok long as you don’t get caught, or have enough money and power that it’s just always ok.
You are confusing right-to-work laws which concern employees while they are employed, particularly as it concerns labor unions, and employment-at-will laws which concern the termination of employment. Employment-at-will does not allow you to fire someone for their race, religion, or sexuality nor for any other reason spelled out by state and/or local law. California, in particular, has a number of other reasons that are forbidden under state law.
But he’s a MAN! that means he is always guilty in every situation because he’s an evil sexist man. BTW men face no problems whatsoever and have perfect lives, #maleprivilege#maleprivilege
