DDOS felony or misdemeanor

It can be a federal crime under the CFAA - Computer Fraud and Abuse Act of 1986. It’s unlikely to have any significant teeth at a state level.

Part of that has to do with jurisdiction. Did the crime occur in the state where the DDoS-er lives? Or the state where the servers reside?

The Attorneys General in question will scratch their heads for a second before they say the magic words in unison: “Interstate Commerce!” That gives them a good and sufficient reason to make the headache the Feds’ problem and not theirs. And since there’s a relevant Federal statute, the Feds really can’t say no.

what will happen is they’ll be found, charged and then a plea deal made to keep them out of prison.
They’ll make sure theyre felons so they can be controlled with threats of prison time, but the FBI, CIA or some other corrupt ABC agency will pay them gobs of money to work for the government.

He’s talking about hackers that know what they’re doing. With enough showing of skill, you have a good chance to be offered a job with the government to commute your sentence.

Anybody tell me if anyone had even been caught and charged in the US? Considering the nature of DDOS it might be very tough to find the originator.

they shouldnt, but it happens enough that you have to wonder if its part of the risk management of doing it, lol.
Get good enough at screwing other folks over and your government might give you a job.
Someone passing bad checks for a long while comes to mind.

i wouldn’t call a DDOS attack as hacking. there are several tools that will allow you to do it without any skill needed in coding to do.
