Sorry bud, but the CoC doesn’t infringe on any constitutional right. The one you probably think it does is freedom of speech. However, if you think that, then you have a gross misunderstanding of what Freedom of Speech actually is. Freedom of speech protects you from being silenced by the government or law enforcement. Freedom of speech does NOT apply to any rules or regulations enforced by public or private organizations within their own jurisdictions. In other words, Blizzard can dictate what you can and cannot say within any Blizzard game, website, or facility. Just the same as how schools can dictate what sort of language is acceptable on school grounds and your parents can dictate what you are allowed to say within their household.

Thing is OP. They aren’t preventing you from saying it. You can say stuff in the game that is against the Code of Conduct. They don’t block or silence you from saying those words, but it’s the consequences of that action is what bites you at the end which you are not safe from your constitutional rights.

In fact, they are being lenient about it. WoW is their property and they have the right to enforce rules of behavior, just like any business’ property, so they could legally do a lot more to restrict players.

Good news. WoW doesn’t do that. They have rules for how they want you to interact with the community if you want to continue enjoying their software service. There is no constitutional right to play WoW so there’s nothing being infringed on.
Rules to encourage good behavior in games aren’t anything new. If I go to my local little league and start shouting obscenities I’m going to be kicked out, and if I try to sue I’ll be kicked out of the court for wasting the judge’s time.

Facebook,Twitter,any forum based or social media website does this… As a business they do have the ability to moderate their own forums with their own rules. The law follows the Constitution and businesses follow that, but we have to listen to the rules made by these businesses or be removed.
That’s why you agree to a ToS…
They are called TERMS OF SERVICE for a reason. You agree to follow their rules or loose your service…this has been a thing in business for like…ever.

First amendment rights have to do with being able to criticize government without getting jailed or killed for it.
