If youre planning on quitting the game then yea you can charge back.
Otherwise you should just live with the consequence of your action and stand by it like a man.
Server queue is a self imposed problem. Im not sure why blizzard needs to do anything about player created problems. You can easily transfer to an open server without queue. Thats what my guild did and now we can play with each other without any problems. And if our server becomes full and will have queues, we will either deal with it or choose to transfer again to avoid queues.
