I would agree with you and I made a post here on the forums carefully reminding players of this.
As it currently stands 2016 Bastion and 2017 Winston skins are listed with the Legacy marker. Demon Hunter Sombra used to be listed as Legacy, but no longer. Tyrande Symmetra and Illidan Genji have not yet be marked as Legacy skins.
