Is the leaver penalty only in games in progress or can I leave in the hero select screen? My matches are 50% new game then a backfill, then another fresh, then a backfill and so on. I also do not want to play clash until they change/fix it.

You can leave without penalty during Hero select phase, in quick play only.
As long as you don’t see the 5s on the “Yes” button then you can leave without penalty.
