Now, as for you switching off of Orisa and going Ashe, while not reportable, it was a bit petty. I agree that they shouldn’t have said what they did oh, but there is also something to be said about rising above other people’s negativity. But, then again, no one is perfect.

You realize that this means you cannot report any person that does not openly declare their intention to throw the game, right? Regardless of how ridiculous their behaviour, you cannot evidence what their actual direct intention was.

I agree but good lord man. I am used to the toxic outburst and finger pointing but I am not joking about that min of whining thing. It got to me because other then that one play we where destroying. I usually mute but I was curious if that would set them off more. It totally did and my 4 gold medal card at the end was just gravy.

I admit I coulda handled it better but every once in a while I just crack.

There’s a difference in making bad decisions for the first time and not knowing better and knowingly making bad decisions despite being called out for it. And the latter is considered throwing. If you continously run into a situation you know you could change by doing something different but you’re not, then you are actively throwing the game, period.

It’s impossible to establish intent to lose, unless a person declares that intention.

But that interpretation of the rule is so absurd that it must be rejected. This is known as the ‘golden rule’ of interpretation.

“The [golden] rule can be used to avoid the consequences of a literal interpretation of the wording of a statute when such an interpretation would lead to a manifest absurdity”

Based on that legal principle he posted, intent is established as long as the player ought to have reasonably forseen that their actions would lead to a loss.

what player A deems to be a bad decision is not necessarily what player B considers bad decisions

I had a Reaper player tell me once in match 1 on Oasis that I needed to pocket him exclusively

He messaged me between rounds that I was making a bad decision by healing others in addition to him. It wasnt phrased exactly like that, but typing the actual message that was sent to me here in this post would likely get me banned, so lets just say that was the gist of it, multiple expletives aside

Second round, I healed everyone, same as before, as I felt that gave us the best chance to win

We won

I’d do it the same all over again, win or lose

TLDR: I was called out for a bad decision that I didnt think was a bad decision, and I wasnt throwing after being called out

There is a difference between bad players and someone intentionally making it hard to win.

If I see someone afking behind a wall never in the fight that I will report. Hammer Torb and battle Mercy? Report. Someone killing themselves over and over by jumping off a cliff? Report.

Someone Ramboing into the enemy over and over and dying? Damn it you suck but you could just be really bad or just over confident in your skills. No Report.

I, like everyone else, has to use their own judgement. Sadly some people draw the line at he isn’t playing or swapping like I want him to! Report!

Right. As far as the doomfist’s perspective, part of that is also a problem with the current system.

You could be playing, say, roadhog and have silver healing and gold hero damage. Based on those stats alone, you might think you’re doing okay. But the system doesnt distinguish good gameplay from bad. You can have gold medals, but that doesn’t mean you’re doing well.

So, sometimes, maybe you do need another player to point it out to you. But that doesn’t mean that they will always do it in the right way. And that doesn’t always mean you won’t listen.

It’s hard, honestly, because a lot of things in the system are very counterproductive and vague.

He isn’t disputing the rule, he is disputing your interpretation of that rule based on the principle you posted.

Yup, that’s why the medal system has been hated since like day one. Still nothing from devs though.

It’s an uphill battle isn’t it? I will point out when someone is doing something poorly or how they are effecting the team but it’s rare to find someone willing to listen.

It doesn’t help that the go-2 for most people is just being toxic and saying you suck! trash! blah blah blah.

The terms and conditions of the game are different than legal definitions in the regards that breaking certain of the rules doesnt involve jail time or time in court or a real life fine

Throwing is one such situation - no legal ramifications for the typical player (excluding pros, their contracts likely have real legal penalties for throwing, which is reasonable given their compensation)

The rules exist, and ergo should be followed; not personal judgement/preferences

So if you do not accept US legal principles and definitions for interpreting the TOS, please provide references to alternate principles and definitions that you believe should apply. Specifically, where in the TOS does it provide definitions or guidance on on interpretation that support your claims?

Blizzard makes the judgement on whether or not the person broke the rules, not the reporter.

The rules that apply to reporting are those made in Blizzards written/published rules

Blizzard has a rule that says you may report player A for x, y, and or z reason

Blizzard defines what x, y, and z are

If player B reports player A for a reason that does not meet the definitions of x, y, or z - said report is a false report, player B has broken the rules of the game, and player B is liable to be actioned, just as many others have been for the same offense
