when I am in game my mouse works for a few seconds then just stops. Then After a few more seconds it works and then stops again. If I am out of the game it works just fine or in other games it works just fine. Just Diablo 4 after the last patch.

What sort of mouse do you have? Is it a generic three button mouse or something else? Wireless or wired?

The games not freezing though, just the mouse?
If so most likley some interaction with the game is causing the mouse driver to crash, then the system is reinitialising it so it starts working again.
Anything in the windows event logs?
I have the same problem with the mouse, did u get any solution?
I have a Razor mouse. Same issues, mouse movement will not register or lag spike randomly. Atleast once every 30 minutes the mouse will completely stop working and the game will keep going, character running aimlessly until I unplug and replug my USB back in. Every other Blizzard game works normally, no issue in starcraft or Diablo 3 which I play prior to or following on the same boot. There seems to be some issue with the code as Reddit has posts from all mouse brands with this happening. I can’t even touch hardcore mode because of this bug since it has already caused me to die to the butcher or other NM dungeon elements when it happens. I’ve been trying to live with this issue since launch, but it may be time to move on from Diablo 4 since it’s still happening in season 1.
I got the Razer Naga Trinity wireless mouse and have the same issue. At first I thought it was generic lag, but then noticed the game itself wasn’t lagging, only the cursor. Then I thought it was latency issues, but I have fiber internet and since it happens so often, it surely couldn’t be that. Besides, I don’t have any other latency issues. Has to be some weird incompatibility with the mouse driver and D4. This is one of those bugs that you can’t ‘live with’ and just ignore since it’s so invasive.
