Once claimed, a Diablo IV Battle Pass cannot be revoked. Customer Service is unable to assist with removing or re-issuing already-claimed passes.

What they fail to realize is this is just like what EPIC got sued for, and lost 250M USD. The crux of the problem is that Click Through agreements or Click Wrap agreements need a confirmation that you are agreeing to purchase or otherwise obtain something by clicking on it. Due to the fact battlepass has a monetary value, and you are obtaining something, it must have an agreement as such at time of purchase. There is a reason you have to agree to when you do not have a battlepass waiting to be used to purchase the item. There is always terms and conditions that come with that purchase.

What we have here is Blizzard dropping the ball on adding the agreement of purchase due to shotty programming (who is actually surprised?). How do we know this? If you do not have the battle pass from the ultimate edition, it will prompt you for the click through to purchase. This means that they just failed to test their code and ensure that there is a click through in place. They also have a click through when you buy ANYTHING from the store, even if you have the free coins that came with the Ultimate edition.

Blizzard is trying to pass the fault on to you consumer, which should come as no surprise to anyone. This is a colossal problem for them, and they are trying to divert the blame by not assuming the liability of the problem. This is exactly what caused EPIC to get sued. The problem was "Epic used a host of digital design tricks – dark patterns – to charge consumers for virtual merchandise without their express informed consent. ". Due to the fact we did not give our expressed consent to consume the battlepass voucher, we are falling under the same precedent as the EPIC games lawsuit.

What I suggest you do is open a ticket, and write Blizzard and let them know you will be signing on a Class Action if one arises. Considering there is prior precedent for these actions, it should be a semi easy slam dunk for any law firm who chooses to take up that mantle. In the case of EPIC, it was buying.
In this case, it’s activating something which you allready had bought.

The battlepass has a monetary value by law there needs to be an agreement of purchase during its exchange.

So you buy Blizzcoins to buy things in the store. EVERY purchase in the Blizz store with those blizz coins has a click through agreement. There is a reason for this. It is no different.

It came with Deluxe/Ultimate edition.
I activated mine, I knew what it was when I clicked on it.
I heard about people saving it for better season, I didn’t give a F, just use it and never buy it again.

I don’t get how anyone can accidently click on it. UI, button location, whatever, it was pretty clear to me what that button was…

Correct. The purchase of the Battlepass is by purchasing the platinum with a normal shop agreement and interface. Then you have to intentionally buy a Battlepass with the Platinum.

What is accidental is ACTIVATING the BP you already approved purchase of. That is still not ok though. Many people might have wanted to wait and use that BP when they were closer to done and knew they had earned the cosmetic rewards, or use it for another season.

It is not ok, but it is also not taking money out of someone’s pocket with an accidental click. They had to have already bought the BP for this to happen.

Glad they acknowledged it though and are changing the activation criteria.

Yeah… Blizzard did not do that. The purchase of the BP was done by each user with informed consent for the purchase. No tricky taking of money like Epic.

That agreement of purchase was fulfilled with the pre-order, but how it’s so easy to accidentally activate is both intentional and shady.

I don’t know how easy it is to open up a specific window and click on a specific button by accident tho. The buttons are big and pretty well identified.

Yeah, right, tell me how defaulting to the activation button on opening the menu and cursors snapping to the box and not requiring a second confirmation aren’t dark patterns. Have fun defending this.

This is not correct. A battle pass can still be purchased via the in-game shop (from the season pass menu) and it can be clicked through without confirmation.

Two separate issues: one where people inadvertently activate their already purchased BP and one where people who didn’t upgrade their purchase package can inadvertently upgrade/purchase a BP without confirmation.

ugh… i completed my battle pass without enabling my “included” pass and my screen was lagged when i was looking at the chapter stuff and miss clicked and hit the GIANT over sized button of empower battle pass… i yelled craaaaa… and boom it was enabled… ugh

oh well im surprised they didnt have a pop up asking if i was sure, so as I was going thru all the junk that i “got” some of them actually popped up “Are you sure you want to claim this armor skin”… I thought wtf is this? I get a pop up asking if im sure if i want to claim something that is account wide but i dont get a pop up for enabling the battle pass… oh well

I still will go “shirtless” in this game to really protest the cosmetics even more now.

Yes I fat clicked the GIANT OVER sized button (they made it GIANT sized to trick people I think). Glad i will never have that button available again to mis click during a studder lag /game freeze…

Funny after it was enabled my latency went down by a lot, its almost like the are purposely lagging your systems out until you click the enchanced battle pass…

That is some tin foil hat conspiracy thinking there. While I’m glad Blizzard is addressing the issue people are having. I didn’t experience any latency issues, read my screen and clicked the button and everything proceeded apace.

Everyone are being contrarians for the sake of it.

If I buy Platinums for money, then head to the shop, which, on hover over items, automatically spends the platinums, would you say that since the point of purchase has been completed prior, this is fine?

The fact is the implementation of the exchange, which holds real world monetary value, is done in a way that is not industry standard. It is extremely easy to misclick and there is no way to stop the transaction, not via a confirmation, not via exiting the screen, nor exiting the game.

Why are people fighting against fellow users wanted to correct what is an obvious flaw in design and get refunded for it. Are you guys getting a commission?
