A few times now my mercenary has become invincible. When their life bar hits zero and you happen to feed them a pot at the same time, they become invincible until you create a new game. Their life bar is gone, but they are still with you.

There is a “Your follower cannot die” on your enchantress.
Have you some screenshots/videos where we can see the follower’s life is empty when she have Smoking Thurible equipped?
D3 has followers, not mercenaries.
D3 has no way to give potions to followers.
Zurtle is correct, that this should be on the Diablo II forums.
