My SP paladin is lvl32 and my Act 2 merc is stuck at lvl 22, he doesn’t gain xp anymore.
You may have to enter a lower level area to level your merc. There is an experience “window” in this game so if your level is too low or too high, you will get less XP from monster kills. For level 22, try killing some enemies in act 3 and monitor his XP.

Take his gear back and buy a new one.
