I filed with the BBB against activison and blizzard on individual complaints. I will file with the AG today.
Filed complaints with both BBB and AG yesterday. We can’t let them get away with fraud, this is not right.
When you purchase a software license to access a game, it is just that - game access. You don’t own the game itself. You paid for access. Access that can be revoked if you break the rules you agreed to. This goes for any game.
You don’t get a refund if you get banned. Not for any game. Again, that is not theft, it is consequences for breaking the rules. False positives can happen, but that is what appeals are for which it seems people here have used.
This is what the AG would review when determining if a company engaged in fraud by accepting your payment that you authorized (which means it is not financial fraud), and holding you to the game rules.
C. The license rights granted to you herein are also subject to the limitations set forth below. Any use of the Product in violation of these limitations is a serious violation of the Agreement, subjects you to immediate termination of your license and, if you are a resident outside North America, additional consequences set out in Section 14(B)(iii), and will be regarded as an infringement of Activision’s copyrights and other rights in and to the Product. You agree that you will not, under any circumstances:
i. use, develop, host or distribute cheats, automation software (bots), modded lobbies, hacks, mods or any other unauthorized third-party software in connection with the Product, or engage in any form of cheating, boosting, or booting;
ii. exploit or reverse engineer the Product (or any of its parts), for any commercial purpose, including without limitation (a) to enable use at a cyber cafe, computer gaming center or any other location-based site without the express written consent of Activision; (b) for gathering in-game currency, items or resources for sale outside the Product; (c) performing in-game services in exchange for payment outside the Product, e.g., power-leveling; or (d) the sale of accounts, log-in information, or other Product materials, access, or rights;
iii. use any unauthorized third-party software that intercepts, “mines”, or otherwise collects information from or through the Product;
iv. except as authorized by Activision in writing, host, provide or develop matchmaking services for the Product, or intercept, emulate or redirect the communication protocols used by Activision in any way, for any purpose, including without limitation unauthorized play over the internet, network play, or as part of content aggregation networks;
v. facilitate, create or maintain any unauthorized connection to the Product, including without limitation (a) any connection to any unauthorized server that emulates, or attempts to emulate, the Product; and (b) any connection using programs or tools not expressly approved by Activision in writing;
vi. violate any applicable law or regulation in connection with your use of Product;
vii. disrupt or assist in the disruption of: (i) any computer, device or server used to support the Product; or (ii) any other player’s use of a Product;
viii. interfere or attempt to interfere with the operation of the Product in any way through any means or device including, but not limited to, launching a denial of service attack, spamming, hacking, or uploading computer viruses or time bombs; or
ix. reproduce, distribute, display, transfer or use any part of the Product except as expressly authorized by Activision; or
x. scrape, copy, aggregate, redistribute, alter, reproduce or re-use any user’s (whether specific to any particular user or as an aggregation) information accessible through the Product. You understand that access to the Product may result in access to other user’s names, screen names, email addresses and other information as set out in the Privacy Policy available at Activision | Privacy Policy (“Personal Information”) which is protected by applicable data protection and privacy laws and regulations. You understand, acknowledge and agree that any Personal Information from other users constitute the confidential information of Activision.

If you purchased something through the Blizzard store, this is what they would use regarding refund policy.
We may withdraw refund eligibility for abuse of this policy, such as repeated refunds for the same product. The same goes for violations of the In-Game Code of Conduct or the End User License Agreement.
In other words, you don’t get your money back when you lose access to a game for breaking the rules and seeing as you don’t own the game (you paid for access only), there is no ownership aspect of the complaint.

I absolutely will either get my money back or be unbanned , myself and many others have not broken any rules. We purchased a product then permanently denied access to it for doing nothing wrong. I did not break any rules, this is fraud. I will gladly ship my PC at my own expense to activisions security department or allow them FULL access to my pc remotely to find what “data manipulation” or “unauthorized software” they accused me of using, I am willing to upload any logs. It is absolutely ABSURD a huge company can do this to innocent paying customers. They can’t prove I used “data manipulation” or “unauthorized software” because I never have!
I’ve never cheated in any game. I never even played the game. I was banned on 10/28/2022 after installing the full game. The game crashed from the home menu, I clicked scan and repair, and was banned. If you don’t think I’m going to get my $100 back you’re sadly mistaken. You can clearly see on my account that the game was never actually played.
I submitted a ban appeal and was denied. How is it possible that I’ve never even played the game and was permanently banned? Again, I don’t want to be unbanned - I simply want my money back.
You might wanna check into that a bit deeper dear. You purchased a licensed copy of said game with a valid VLK. You therefore now own a legal copy of that game. The only thing they grant you access to, is the server side game platform to play on.
Activision knows they have a serious problem with MW2. It crashes on all platforms and the game files get corrupted to include the " game_ship.exe " If the repair tool and the games instability is the cause of that corruption, then it’s on Activision to fix it and reverse all bans associated with such. Modern day hacks do not alter executable’s and haven’t for years now !!!
Do not listen to MissCheetah regarding this issue. There is precedent from other players contacting the attorney general and receiving positive results. I can’t link anything on these forums but do yourself a favor and research this issue. Contacting the attorney general and filing a complaint is exactly the way you need to handle this situation if you have been banned for no reason and are being denied a refund.
If you are allegedly in violation of a service agreement and the company permanently bans you they are obligated to explain to you why that happened. “3rd party software” isn’t sufficient. Although we know now that graphics card software may be generating false positives to RICOCHET anti-cheat software, activision needs to be transparent when they decide to take your money and not grant you access to the license.
File a complaint with the California AG and the BBB and believe me, if enough people do this Activision will be forced to act.

This isn’t helpful as the people complaining about being banned are complaining because they, like me, did NOT cheat and are now barred from playing the game. By your own words this is a breach in their own TOS. But thanks for the copy and paste bud. much appreciated!
Blizzard really needs to review their MVP program… You see thousands of people complaining about the same issue and you seriously think that they’re all in the wrong? C’mon man…
There lies the problem. Most of us genuinely want to play the game and were banned for no reason. Blizzard refuses to help their paying customers. We payed for a game we have no access to and most of us didn’t even get a chance to play the game. How can we be cheating without ever actually playing multiplayer. Something is obviously wrong here but nobody on either end offers any assistance or guidance. I too have filled out complaints with BBB and California Attorney General.
you’ll get nothing accomplished with the AG of CA because CA is corrupt like Blizzard I think other means will have to be necessary.
