open diablo properties go to compatibility tap run program as windows vista service pack 1 then under setting in the tab check reduced color mode and make sure it is set to 8 bit (256) color and make sure to run as administrator
also if you are using the shortcut icon, after the .exe add a space, and add the following command -windowmode. also from the drop down menu select minimum window and apply
