You’re not entirely wrong.
However, we are not speaking solely of legality.
Alliance have a slight advantage when both sides are zerging. The Alliance bridge is a major chokepoint and leaves the Horde offence completely in the open to the defense. The A base gy flag is also right in front of the boss room, making it a bit easier to defend.
However, if it’s not a zerg, then it really comes down to which side has the better offense with a competent enough defense to keep the other side from winning the race. The differences are minimal and the better team will win.

There are more alliance so more hardcore alliance playing.
Since it’s 40v40 its fair but once the horde start quitting because they have completed their ranking it becomes 30v40 people who care because the alliance have to rank for way longer before they can quit.
ontop of this horde que is faster so theres less incentive to care.
Alliance leave the gate with 10% all stats and 250attack power where as horde don’t get this buff, horde can get windfury but you gotta be near the shaman doing it and in their group, 2 alliance paladins can buff the entire raid and leave the bg still having full effect. (pally op asf)
Horde play more rogues than alliance by far and rogues arent good for battlegrounds as far as scans ive seen alliance get more mages and mages rule for BG.
