Social Contract with Current subs

It’s 5 o clock somewhere.

That somewhere is Australia, apparently.

google does have a time converter.
We also have multiple time zones since we are a continent

So I read some of the Australian consumer laws I think this is the stuff that matters most on refunds.
A service has a major problem when:

  • it has a problem that would have stopped someone from buying it if they’d known about it
  • it has multiple minor problems that, when taken as a whole, would have stopped someone from buying it if they’d known about them
  • it is substantially unfit for its common purpose and can’t easily be fixed within a reasonable time
  • it does not meet the specific purpose you asked for and cannot easily be fixed within a reasonable time
  • it creates an unsafe situation.
The fact that they are laying it out in advance and allowing you ample time to cancel to me would mean you wouldn’t be entitled to a refund. The game is not changing in any substantial way and all they are asking is that you behave as a non terrible human.

There is no new policy, just a reminder of policies that have been in place since the game was released, and a statement of intent to enforce those policies, which has also been codified in the ToU and EULA for the past 18 years.

And again, the ToU and EULA have been changed several times since 2004, and I doubt anybody in this thread can cite a single instance of a successful legal challenge to those alterations under Australian consumer protection laws, or those of any other nation or jurisdiction.

Can’t believe so many of us took the bait, if OP wants a refund for their unpaid sub then have at it. If you think you’re going to get a refund for the pay 15 years of sub fees and what you paid for each expansion you are out of to ur mind.

But by all means if you want them to delete all of your stuff for 15 bucks just so you can have regret a week later that’s your right I guess in Australia.

I think the sad thread because GMs won’t restore a deleted account would be worth the read.

Dude, you need to realize that there are more countries than Australia and GAWD read the thread.

(I really hope you didn’t just upvote me because you thought I was being serious…)

I mean the bare necessities

That brings the bare necessities of life”

I believe the OP was citing Australian law so that’s what I read. I understand there are other countries but again this thread started out pertaining to Australia so that’s what I looked at. My bad for some how making you think I didn’t care about other countries. I did read most of the thread but I’m also busy at work so I may have missed some critical piece of information apparently.

I was just being facetious. Anytime someone gave the OP an answer that basically said they don’t get a refund, they accused the person of not reading the thread or having basic knowledge of countries outside the US.

I apologize if I offended you.

no man you actually looked it up which is more than most.
in all seriousness what you cited is where i was confused.

the first point was
it has a problem that would have stopped someone from buying it if they’d known about it

THIS NEXT PART IS JUST MY OPINION ON THE TOPIC

so taking into account that first line.
lets say they force you to agree to the new “T&C” to continue playing even if you have active game time.
so what i mean is. you need to press a button saying i agree.
if you do not, within the concept of that first statement, one could argue that they would not have purchased the game time for that length if they knew it was coming.

thats all i really wanted to know from blizzard.
in hind site i think i should have just emailed this.
but yeah was a good convo with everyone.

No I’m good. :beer:s on you.

I am actually so proud of your growth in such a short time.

Pretty sure the content of the social contract is already covered in the EULA, they’re just putting it in your face and giving you an option to opt out of playing.

This would be no different than Blizzard suspending your playtime or banning your account for violating the EULA. They don’t issue refunds for those things either AFAIK.

I’m pretty sure over the 17 years of the game being active they’ve changed their T&C many times.

My question is what specific wording of the law does adding a social contract break in Australia?

I keep seeing this talked about but not the exact wording of the law in question that the social contract will be causing a refund. I may have missed it but haven’t seen it.

Have you consulted a lawyer about this I’d your concerned?

just to reiterate, this is all hypothetical, i am not looking for a refund.

But to answer your question just check out crazyirish post ( one or two above us) and then my response to it. should hopefully clarify my question.

p.s
sorry dude i dont know how to copy multiple posts into a reply.

I got about 30 posts in and I think this is a question for someone whos actually familiar with these laws. I highly doubt you’ll get a satisfactory answer to your query from a forum where the majority of its users are in north america and arent well versed in law.

I am not a lawyer but…
