Not really considering you cannot prove if someone is at there keyboard or not. If I want to want watch a YouTube video on one screen and casually play wow on the other how can you tell the difference between me getting up and taking a piss and not getting up just standing there a few minutes while I watch my video.

Blizzard can see quite clearly if you have a habitual tendency to do so.

I don’t need to. Blizzard can, again by simply looking at your activity over time.

You should probably go see a urologist if you are having to urinate so often. The AFK mechanic is designed for people who are actually going afk.

It is a slippery slope as nothing is clearly defined all left at blizzards discretion and that means you can be banned for anything.

I believe this is what blizzard considers when they are making rules. Players like you will lawyer them to death. Precisely why they leave rules open to their own discretion.
