Asking for it to be not only dropped, but Dismissed with Prejudice is a bit… sketchy. Was there some sort of out of court settlement or something?
We don’t know if there was. The court papers didn’t say, but that’s pretty likely, yeah. I believe that’s private information.

The annual report revealed news of 8 other shareholder lawsuit’s being litigated not including Kanhert vs ATVI (a derivative case of Cheng vs ATVI) Names as well as case numbers were given

Speaking of which on May 19th the original complaint for Cheng vs ATVI was revised meaning it’s still in the running (ie not cancelled as reported)

The main fratboy case continues on it’s mollusc like progress. ATVI’s lawyers keep earning their keep by asking for the case to be dismissed. Lawyer’s gotta lawyer I guess.

Yes the parents of the Moynihan case asked for their case to be dismissed. The dismissal request gives no clue as to if they received a settlement or just simply run out of time , money and energy.

Activision publishing’s case against Engine Owning got dealt a severe blow by the judge wanting to dismiss the case for lack of prosecution. However it looks like they got granted an time extension to convince the judge not to dismiss the case.

New york city public employee retirement funds made a 220 lawsuit against ATVI that seems misunderstood by many parties. It’s a bit complicated to talk of here so I’ll use a new post for that.

They name Keri as an Activision Blizzard employee. This is incorrect. Court documents reveal she was a finance manager at Activision Publishing with a supervisor that can be verified on Linked in as formerly working for Activision Publishing. Yes ATVI being the parent company technically means she is an employee under ATVI but she didn’t work directly for them.

Declaring the lawsuit dropped. Yes the plantiffs have asked for it to be dismissed , however that has yet to be recognized by the court. It’s highly likely it will be but technically , as of right now it’s still on the court’s books. It’s not dismissed yet it’s official status is “Request for dismissal” . It is not dead dead only mostly dead.

Let me summarise the 28 minute video for you :
- This is a 220 lawsuit. As I understand it a public company does have to give up certain records if certain parties ask for them. If they refuse they can file this type of lawsuit
- It is being brought by certain new york city public employee retirement funds
- They had some concerns when the original news of all this sexual harrasment broke with the fratboy case. While the “getting a good deal in the merger” is mentioned it wasn’t the original reason of the 220 files request
- The lawsuit will be testing if the request was a proper request under Delaware corporate law (where ATVI is incorporated)
- Under Delaware law the burden of proof is on the accused corporation to “establish that the inspection such stockholder seeks is is for an improper purpose”
- In Delaware the court assumes that if your a stockholder your request to see documents is correct. The corporation can then counter that assumption by showing the request is for an improper purpose.
- As such it is not an admission on the part of Bobby Kotick , Activision or Activision Blizzard as to liability. It’s a files request only
- The only thing the plantiffs will “win” in this lawsuit is copies of certain records from Activision Blizzard. That’s it
- There will be no criminal charges laid or will their be any fines issued on this. The most they will get is records.

Yeah I wasn’t aware of that New York retirement one. Even though it isn’t alleging criminal activity or financial liabilities (just yet), it does shed an interesting light on these proceedings.
I guess they want to make sure Microsoft will cover what ever agreements Blizz has made. It is a good question. Maybe that doesn’t effect Players as much as other aspects of the various lawsuits.
I can imagine Gallywix sealing the biggest deal in the history of video games, garnering massive profits… and still selling out retirees by voiding previous contracts with legalize. I can understand the concern.
Has there even been updates on Microsoft buying Blizzard? That seems to have stagnated.
There’s not much to it. Microsoft recently confirmed that some future Activision games would be Xbox-exclusive.
AFIK the merger agreement has covenants in it saying ATVI has to honor all previous contracts until the deal is done
I haven’t seen any news about the FTC litigating to block the deal so I’m going to assume its going great.
Bear in mind folks there’s a number of conditions for this deal to pass including approval from Agencies in the US, EU , UK and China.

Resurrecting this thread just to point something out.
ATVI posting that they investigated themselves *does not* mean all lawsuits over , pack up the lawyers and go home.
It is a submission to the SEC to assuage stockholders ahead of an annual stockholder vote. A vote that went very well for ATVI.
It does not mean the lawsuits are now dismissed and over. It could be used as evidence but it’s not the smoking gun everyone thinks it is.
I haven’t found any recent news about the lawsuit. Honestly, I don’t know what stage it’s currently at. But, I should make sure this thread isn’t forgotten.
