Are unsolicited guild invites considered spam?

It’s not against the rules to send messages to others and ask them if they’d like to join your guild but doing so in mass can be seen as spam by the community and reported as such.

Someone sending one whisper isn’t going to get actioned. If it’s spammed out, then it could.

I, personally, am not going to Karen it up and report someone for one whisper. But that’s just me.

It depends on how many reports they get. If someone is annoying enough people with the spam invite whispers the GMs will do something about it. If the community really does not care, and does not really report it, then they won’t action it. One report alone won’t get them penalized.

I could report any unsolicited whisper as spam - and it is. They don’t go after just any single unsolicited whisper though. They want the people who are annoying everyone asking about their extended mount warranty (and if they want to join a guild). Same concept as the robo-spam phone calls.
