If that program hooks into/injects into Diablo IV in any way, then yes. Of course, as stated previously, things like Discord or Steam’s overlay should work fine as they are very commonly known programs. Overwolf has been under scrutiny in DOTA 2 at least for providing an unfair competitive advantage, I wish it wasn’t tolerated there either.

Reading a ToS is one of the dumber things you can do with your time and these ‘contracts’ aren’t even legally binding from my understanding in some states. They don’t really mean anything to the end user
You can’t expect people to read through a bunch of lawyer gibberish to play a game. That is unreasonable. If Blizzard made people actually sign and read through a legit contract to play a game, then a lot of people would elect to just not play that game.
You are looking at these situations way too literally when you should be trying to approach situations like this as a human while having the utmost respect for the customer.

They won’t do it. If they don’t control and make the software then it can change at any time. They won’t approve anything. There is an approved list - the game, and only the game should be used with the game. It would also be impossible to keep up with all the stuff people would want on/off a list. Legally binding in what sense? Yes, they can terminate your use after purchase without backlash if you agree to ToS and break the terms.
Legally binding as in you can be arrested for it? No.

Since in the EULA it states they scan pretty much every running process, so I wasn’t sure if that wasn’t common knowledge or if there was something else I was missing, regardless on the ethics/logic behind monitoring it all.
Their “Consent to Monitor” is daunting, but section 1.C is really clear.
They are legally binding in most areas but not completely and therefore I would look at them like a layer of defence to use to avoid potential wrong doing or liability by Blizzard. They don’t just give Blizzard a pass to do whatever they want, and they also don’t force Blizzards hand to not remedy an issue like this that is obviously just a minor misunderstanding.
Not to mention they literally don’t have to give any sort of reason or rationale as to why someone was banned, I highly doubt they just go around banning for fun, but hey, could be.
First off I wasn’t using it for my campaign run I had it on for my Druid build I was playing and didn’t shut it off when I got into my sorcerer. I tried submitting a ticket but it says failed each time I submit one and the auto resolves and ask to take a survey. The mobalytics doesn’t read anything In game just tips on builds nothing to get an upper hand on anything l. It was my mistake to even think this was safe in any way. I should have alt+tab… it was just convenient and wanted to try it.
I hope you can get some clarification to find out if that was the reason or not, I’m assuming they haven’t given you any details yet?
Nope other than the email saying I was using a 3rd part program to cheat or alter the game.
